TERMS OF SERVICE

THESE TERMS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN COURT OR JURY TRIALS OR CLASS ACTIONS AND ALSO LIMIT THE REMEDIES AVAILABLE TO YOU IN THE EVENT OF A DISPUTE. CAREFULLY REVIEW SECTION 13 BEFORE YOU AGREE TO THESE TERMS.
These Terms of Service (these "terms") contain the general terms and conditions that apply to customers, users, and visitors (collectively, "users," or "you") of CRUZERO's ("CRUZERO's" or "our") online and mobile services, including the app Cruzero - Cruise Companion Finder, all services made available through the website, and all other applications, digital resources, or communications offered by CRUZERO (collectively, the "services"). CRUZERO is an LLC organized under the laws of the State of Florida, having its principal place of business in the State of Florida.
1. ACCEPTANCE OF TERMS
These terms are an agreement between you and CRUZERO. Please read these terms carefully as they govern your conduct when using the services. These terms are incorporated into and are supplemental to CRUZERO's Privacy Policy, as well as any other specific, written agreements you may have with CRUZERO with respect to a service.
By using the services, you accept and agree to be bound by and abide by these terms. By using these services you represent and warrant: (a) you are sixteen (16) years of age or older and have permission of your parent or guardian, if you are under the age of majority where you reside; (b) you have good right, title, and authority to enter into these terms; (c) you understand and acknowledge the risks associated with meeting cruise companions and sharing cabins with individuals met through our platform; (d) effective as of the date you first use the services, these terms constitute valid and binding obligations enforceable against you as described herein.
2. GRANT OF LICENSE
The services, including all displays, images, video, and audio, as well as the design, selection, and arrangement thereof, are owned and provided by CRUZERO.
CRUZERO hereby grants you a non-exclusive, non-transferable, non-sublicensable, worldwide license to use the services subject to the restrictions in these terms. CRUZERO expressly reserves any rights not expressly granted herein. You are solely responsible for any hardware, software, and telecommunications necessary to access the services and CRUZERO makes no warranty or guarantee that the services will always be available or will not change.
3. CABIN MATE MATCHING AND CRUISE COMPANION SERVICES
CRUZERO provides a platform for users to connect with potential cabin mates and cruise companions. You acknowledge and agree to the following terms specific to these services:
3.1 Verification and Safety
CRUZERO implements basic verification methods but cannot guarantee the accuracy of user information
Users must complete our verification process before accessing cabin mate matching features
Users are responsible for their own due diligence before agreeing to share a cabin
CRUZERO reserves the right to deny or revoke access to matching features based on user behavior or verification concerns
3.2 Financial Arrangements and Payment Management
3.2.1 Cruzero Payment Management Service
CRUZERO offers an optional payment management service for cabin sharing arrangements
Users who opt into this service agree to process all cruise-related payments through our secure platform
Our payment service includes:
Secure deposit holding
Payment milestone tracking
Automated payment scheduling
Payment dispute resolution support
Documentation of all transactions
Service fees apply and will be clearly disclosed before enrollment
Users of this service are protected by our Payment Protection Policy
3.2.2 Independent Financial Arrangements
Users may choose to manage payments independently outside of CRUZERO's payment service
Users who choose not to use CRUZERO's payment service:
Assume full responsibility for all financial arrangements
Are solely liable for any payment disputes or issues
Must still document their agreements through our in-app system
Waive any right to CRUZERO's payment dispute resolution assistance
Accept all risks associated with independent payment arrangements
3.2.3 General Requirements
All financial arrangements must be documented through our in-app agreement system regardless of payment method
Users must clearly document all cost-sharing arrangements before booking
Any modifications to financial arrangements must be recorded in the app
Users are responsible for compliance with cruise line payment policies
CRUZERO reserves the right to suspend matching services for users with unresolved payment disputes
3.3 Booking Requirements
Users must comply with all cruise line policies regarding cabin sharing
Verification of actual cruise bookings may be required
Users must be of legal age to enter into cabin sharing agreements
Some cruise lines may have specific requirements or restrictions for shared cabins
3.4 Communication Guidelines
Initial communication must occur through our platform
Personal contact information should not be shared until both parties agree
All communications regarding financial arrangements must be documented in-app
Users must report any suspicious or inappropriate behavior
4. LICENSE AND USE RESTRICTIONS
Except as expressly authorized under these terms, you may not:
Copy, modify, or create derivative works of the services
Rent, lease, lend, sell, license, sublicense, assign, distribute, publish, or transfer the services
Reverse engineer, disassemble, decompile, decode, adapt, or otherwise attempt to derive or gain access to any software component
Remove any proprietary notices from the services
Create fake cruise itineraries or cabin listings
Misrepresent your cruise booking status or identity
Use the services to circumvent cruise line booking policies
Use the services in connection with or to promote any illegal activities
Collect personal information about other users without their explicit consent
Use the services to harass, stalk, or harm other users
Post false, misleading, or fraudulent content about cruises or cabin sharing
Attempt to manipulate our matching system or user ratings
5. TERMINATION AND REFUND POLICY
We may terminate your access to the services at any time for any or no reason, unless otherwise provided in an express, written agreement between you and CRUZERO. Upon termination of your access to the services, you shall immediately discontinue use of the services.
Refund Policy for Premium Services:
No refunds will be issued for terminated accounts due to terms violations
Pro-rated refunds may be available for unused premium service time
Refunds for cruise-related disputes must be handled directly with the cruise line
Premium service purchases are non-transferable
6. USERNAME AND PASSWORD
You are responsible for:
Maintaining the confidentiality of your account credentials
All activities that occur under your account
Immediately notifying us of any unauthorized access
Creating a strong password and updating it regularly
Not sharing your account access with others
Logging out from shared devices
CRUZERO reserves the right to disable any account that violates these terms or appears to be compromised.
7. USER-GENERATED CONTENT
When submitting content to our platform, you agree to the following:
7.1 Content Standards
All cruise-related information must be accurate and verifiable
Cabin photos must be authentic and current
Reviews must be based on actual cruise experiences
Price discussions must clearly indicate all included fees
Profile information must be truthful and current
7.2 Prohibited Content
Spam or commercial solicitations
False or misleading cruise information
Discriminatory or hateful content
Explicit or inappropriate material
Content that violates others' rights
Fraudulent cruise or cabin offers
7.3 License to Content
By submitting content, you grant CRUZERO a worldwide, non-exclusive, royalty-free license to use, modify, reproduce, and distribute such content for platform purposes.
8. DISCLAIMER OF LIABILITY FOR IN-PERSON MEETINGS
Users participate in in-person meetings and cabin sharing at their own risk. CRUZERO strongly recommends:
8.1 Safety Practices
Meeting virtually before committing to cabin sharing
Sharing travel plans with trusted contacts
Using cruise line official channels for payments
Meeting in public places if meeting before the cruise
Following cruise line safety protocols
Keeping emergency contacts updated
8.2 No Liability
CRUZERO is not liable for:
Personal injuries during cruises or meetings
Property damage or theft
Financial disputes between users
Misrepresented user information
Cruise cancellations or changes
Conflicts between cabin mates
Any damages arising from cabin sharing
9. INDEMNIFICATION
You agree to indemnify and hold CRUZERO harmless from any claims, damages, or expenses (including attorney fees) arising from:
Your use of the services
Your violation of these terms
Your interaction with other users
Your cabin sharing arrangements
Your cruise-related activities
Your user-generated content
Any misuse of the platform
10. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Accuracy of user information
Reliability of cruise companion matches
Success of cabin sharing arrangements
Availability of cruise bookings
Security of the platform
Uninterrupted service access
Compatibility with your devices
Success of finding suitable cabin mates
11. LIMITATION OF LIABILITY
IN NO EVENT SHALL CRUZERO'S TOTAL LIABILITY EXCEED THE LESSER OF:
Fees paid to CRUZERO in the past 12 months
One hundred dollars ($100.00 USD)
This limitation applies to all damages, including:
Failed cabin mate arrangements
Cruise booking issues
Personal injuries
Property damage
Financial losses
Data breaches
Service interruptions
12. NOTICES
All notices to CRUZERO must be sent to: Email: support@cruzero.com Address: [CRUZERO ADDRESS]
CRUZERO will send notices to the email address associated with your account.
13. GOVERNING LAW AND ARBITRATION
13.1 Governing Law
These terms are governed by Florida law, without regard to conflict of law principles.
13.2 Arbitration Agreement
ALL DISPUTES MUST BE ARBITRATED ON AN INDIVIDUAL BASIS. You agree to:
Waive your right to court or jury trials
Waive your right to class actions
Submit all disputes to binding arbitration
Arbitrate only in your individual capacity
13.3 Arbitration Process
Arbitration will be conducted by the American Arbitration Association
Proceedings will be held in Florida
Filing must occur within one year of the dispute
Each party bears their own costs
The arbitrator's decision is final and binding
13.4 Opt-Out
You may opt out of arbitration by emailing support@cruzero.com within 30 days of account creation.
14. CHANGES TO TERMS
CRUZERO may modify these terms at any time by posting updates to our website. Your continued use of the services constitutes acceptance of any changes.
